Norway mass killer applies for college courses

By KARL RITTER

The Associated Press

Published: August 1, 2013

STOCKHOLM -- Convicted mass killer Anders Behring Breivik has applied for admission to the University of Oslo, testing the limits of Norway's commitment to rehabilitate criminals rather than punish them.

The right-wing extremist, who killed 77 people in bomb and gun attacks two years ago, wants to study political science, and prison and university officials say he could do his studies in his cell if accepted by the school.

"In Norway, and I'm proud of this, we have a system where inmates, in general, can apply to study at universities, most of them from their own cell, so it will be distance learning," said Ole Petter Ottersen, the rector of the University of Oslo. "This is a principle that is put in place to help the inmate get back to society."

Ottersen said he couldn't comment on prospective students but added it was "publicly known" that Breivik had applied to the university.

Others, including Education Minister Kristin Halvorsen, have said Breivik is a special case and shouldn't enjoy the same rights as other prisoners.

The self-styled anti-Muslim militant surrendered to police on July 22, 2011, after setting off a bomb outside the government headquarters in Oslo and opening fire at a summer camp for young Labor Party activists on Utoya island. Eight people died in the bombing and 69, mostly teenagers, were killed on the island. Breivik showed no remorse for his actions, calling his victims traitors for supporting a multicultural society.

"This is a special situation because we are facing a mass murderer who will never again be released into Norwegian society," Halvorsen told broadcaster TV2 this week. "So many of the arguments we have for encouraging inmates in Norwegian prisons to get an education don't apply to the same degree."

Breivik's defense lawyers were startled by her comments, saying there is no legal basis to deny him the education rights that other inmates enjoy.

They also criticized her assumption that Breivik, 34, will never be released from prison.

"That is not up to politicians to decide," said Tord Jordet, who is part of Breivik's legal defense team.

Breivik was sentenced to the maximum term of 21 years. After that a court can extend his sentence if it considers him a danger to society.

He is being kept away from other inmates at Ila Prison for security reasons, and has access to newspapers, TV and radio but no Internet connection.

His university application is expected to be processed this month.

Ottersen, the university rector, said prison authorities decide how an inmate should conduct his or her studies. "The role of the university is to provide the learning material and to evaluate the exams," he said.

Per Anders Langeroed, an Oslo city councilman who survived the Utoya massacre by swimming from the island, said it's worth discussing whether helping Breivik get an education was "resources well spent."

Still, Langeroed found "no reason to deny him the right to read some books and take some exams," providing that teachers and other students wouldn't have to interact with him.

"Because what we experienced when we faced terror was that when everything around you fell and you were afraid of everything, the comforting thing was to hold on to some basic principles," Langeroed said.

European shares kept buoyant by data, earnings

* FTSEurofirst 300 up 0.2 percent

* AB Inbev, Bayer (Milan: BAY.MI - news) rise after results

* Investors strongly buy protection ahead of Fed

By Tricia Wright

LONDON, July 31 (Reuters) - European equities rose on Wednesday, kept buoyant by robust data out of the United States and Europe as well as strong earnings releases from major companies.

The FTSEurofirst 300 closed up 0.2 percent at 1,208.17 points, with drinks group AB Inbev leading the gainers, up 6.9 percent, after unveiling higher profits.

Equity markets found some support from data indicating U.S. economic growth accelerated unexpectedly in the second quarter and a separate report showing U.S. private employers maintained a higher pace of hiring in July.

This added to a brightening economic picture in the euro zone, where the number of people unemployed fell for the first time in more than two years in June.

"If the economic environment continues to improve ... then it's very difficult to see what's going to derail the equity markets over the short to medium term," Neil Veitch, investment manager at SVM Asset Management, said.

The FTSEurofirst 300 index is on course to record its best monthly gain since June 2012, having bounced nearly 9 percent off a low of 1,111.11 points hit towards the end of last month.

Despite the market remaining buoyant on Wednesday, investors have been strongly buying protection ahead of the U.S. Federal Reserve's policy announcement, expected to shed light on the outlook for the central bank's quantitative easing programme.

OUTLOOK BRIGHT

The European second-quarter earnings season has proved mixed so far, with profit warnings last week from engineer Siemens and chemicals group BASF contrasting with better results elsewhere.

Of about 44 percent of STOXX Europe 600 companies to have reported second-quarter results, 52 percent have met or beaten market forecasts, according to Thomson Reuters StarMine.

On Wednesday, Bayer advanced 3.6 percent after posting stronger-than-expected new drug sales, with AB Inbev and Bayer among the biggest points contributors to the FTSEurofirst 300.

"We can see light at the end of the tunnel with the potential for positive surprises next time around," said Ben Kumar, research analyst at Seven Investment Management, which is "overweight" European equities.

"Since February earnings expectations have been revised down and down and down in Europe; the more they are revised downwards the more the chance is of them beating... Fundamentals in Europe are improving and that will eventually start to come through."

Google Play Surpasses App Store in Downloads but Still Lags Behind in Revenue

Google Play Surpasses App Store in Downloads but Still Lags Behind in Revenue

Published on 07-31-2013 04:28 PM

According to a recent study, Google Play for Android has finally surpassed its rival app repository but the App Store still maintains a strong edge in terms of revenue generated for developers. The figures come from the App Annie blog, which measured app downloads in the second quarter of 2013 along with other indicators. App Annie found that Google Play downloads exceeded App Store downloads by 10% in the quarter, attributing that growth in no small part to app download growth in developing markets such as Russia, China, Brazil and India.

The fact that Google Play has only now just surpassed the App Store in terms of downloads is likely a testament to the greater engagement of iOS device owners with their devices. Android is estimated to run roughly three out of four mobile devices shipped worldwide but at least one-third of those running a year-old version of the Android OS, meaning that they may not be as well able to access recent apps and their users may not be downloading as many apps.

Google Play has also surpassed the App Store in terms of overall app volume. The Play Store now counts more than one million apps in its library while the App Store, according to the last count, has just over 900,000. Apple?s offering though, beats Google when it comes to tablet-optimized apps, with 375,000 apps built for the iPad while Google struggles to get developers to optimize their apps for the myriad of Android tablets.

The App Store also beats Google in what may be considered the most important category as well: overall revenue generated both for the store and for developers hosted therein. App Annie?s study found that the App Store generated 2.3 times the revenue of the Play Store, despite the Play Store?s 10% advantage in overall downloads. The figure was slightly down from the 2.6 times figure that App Annie found in its previous examination of the market. The revenue gap has resulted in a competitive edge for Apple in terms of app quality and developer loyalty. Developers with App Store offerings have made more than $11 billion in sales since the store?s opening, with half of that coming in the last four quarters.

We?ll have to see how the market evolves with all the changes both tech giants continue to push for with their future plans.

USCIS union president cautions lawmakers on House-fashioned DREAM Act

The president of the union representing U.S. Citizenship and Immigration Services officers and staff voiced concerns to Republican House members about proposals to grant legal status for undocumented immigrants brought to the United States as children.

In a letter?sent Tuesday night to Majority Leader Eric Cantor, Budget Committee Chairman Paul Ryan, Judiciary Chairman Bob Goodlatte, Immigration and Border Security subcommittee Chairman Trey Gowdy, National USCIS Council president Kenneth Palinkas questioned the wisdom of adopting legislation under the Obama administration to legalize undocumented immigrants brought to the country illegally.

The letter is also copied to the GOP members of the House Judiciary Committee.

?As you know the Obama Administration has already bypassed Congress to implement a version of the proposal you are now considering. Of course, to do so, the Administration had to simultaneously suspend laws previously passed by Congress? What is to stop the Administration from simply issuing another round of non-enforcement orders (written or oral) that would eviscerate any attempted limitations in your bill?? Palinkas wrote.

House Majority Leader Eric Cantor and House Judiciary Chairman Bob Goodlatte have reportedly been working on legislation aimed at granting a pathway to citizenship for undocumented immigrants brought to the United States as children.

Last week the House Subcommittee on Immigration and Border Security held a hearing on the matter. While Democrats on the panel said that legalization for just the children was not enough, most of the Republicans on the panel signaled they would be open to such a proposal.

Palinkas? letter was full of questions about the likelihood that such legislation could be extended or circumvented by the Obama administration and how members would prevent that from happening.

?If these solutions are not provided, a DREAM Act-style bill could quickly turn into a permanent feature of U.S. immigration policy with huge unintended consequences. In practice, it could establish a precedent that would expand birthright citizenship in the future to apply to any new arrivals (and, by extension, their relatives) who claim they came here at a certain age,? Palinkas wrote. ?Clearly, this would be an extraordinary magnet for unlawful entry and overstays, and create a massive hole in future enforcement.?

Palinkas, whose union was vocally opposed to the Senate immigration bill, added that the needs of USCIS have been overlooked as, he noted, the agency lacks the resources it needs to ?ensure that the millions we admit into the country properly qualify for the immigration benefits they seek.?

?Until our inadequate resources as USCIS employees are upgraded and the culture of the current Administration changes, U.S. citizens will continue to be put at needless risk,? he wrote calling for more full-time permanent staff.

He stressed that USCIS is ?ill-equipped? to process ?the sort of far-reaching plans before Congress right now? and requested that lawmakers work with USCIS adjudicators as they move forward with their immigration proposals.

?The sponsors of the Senate legislation pushed aside the opportunity to work with ICE and USCIS professionals and therefore produced a 1,200-page bill that greatly weakens our national security and produces more illegal immigration. I would therefore urge all House lawmakers not to conference with the dangerous Senate bill that will produce a totally deficient comprehensive proposal,? he wrote.

Ted Cruz Wants YOU (To Help Get Rid of Obamacare)

In a talk at the Heritage Foundation on Tuesday, Ted Cruz argued in favor of his plan?along with fellow Sens. Mike Lee and Marco Rubio and other tea-party members?to use the continuing resolution debate at the end of September to defund Obama's health care law, emphasizing the importance of grassroots efforts to win the fight.?

Cruz, the Republican senator from Texas, presented the plan as the last and only chance to eliminate the Affordable Care Act. "If we don't do it now, in all likelihood we never will," Cruz said. "In modern times no major entitlement, once it was implemented, has ever been unwound." Once the exchanges and subsidies are in place next year, Cruz argued, the administration will likely have already succeeded in getting as many Americans as they can "addicted to the subsidies, addicted to the sugar," thereby drastically diminishing prospects for full repeal.

Cruz's plan risks a government shutdown unless Obama agrees to defund his signature legislation, a virtual impossibility. Yet Cruz emphasized the necessity of dramatic action and slammed Republicans in the House for their continued "empty symbolic votes with no chance of passing." The House is scheduled to vote for the 40th time this week to repeal Obamacare.

In order to convince the necessary 41 Republicans in the Senate or 218 in the House to support his plan, Cruz emphasized the need for "unprecedented levels" of grassroots efforts. He called upon individuals to join the fight and pressure their representatives to join in refusing to fund the law.

Cruz responded to Republicans' concerns that another government shutdown would harm the party and damage 2014 election chances, calling them "haunted by the ghost of shutdowns past." Although conventional wisdom is that Republicans were to blame for the 1995 shutdown, Cruz argued that government shutdowns are far from disastrous. "The world didn't end; planes didn't fall out of the sky, Social Security checks didn't stop, military paychecks didn't stop, we didn't default on our national debt." While saying he certainly didn't want shutdowns to continue indefinitely, Cruz emphasized the temporary nature of shutdowns and argued that it was important for Republicans to stand up for their principles.

Winding down his talk, Cruz's rhetoric became a kind of inspirational battle cry. He quoted Margaret Thatcher ("First you win the argument, then you win the fight"), and asked, "If we're not willing to fight on Obamacare, what are we willing to fight on?" Appealing to his audience of bloggers, he said they would be the ones to win it. "New media is a terrific destabilizing force," and a crucial element of the grassroots battle to defund the health care law, he said. ?

Cruz ended with a message to Republicans who do not like his approach: "What is your alternative?" It's a question that, ironically, many have posed to the GOP with regard to Obamacare.?

Tino Martinez resigns as Marlins hitting coach

MIAMI (AP) ? Tino Martinez resigned as the Miami Marlins' hitting coach hours after complaints by players that he verbally abused them became public.

In one instance, Martinez acknowledged he angrily grabbed a player.

Martinez was in his first year as a professional coach this year. He sat in the dugout during Sunday's 3-2 win over the Pittsburgh Pirates, then met with Marlins officials and resigned.

"I want to apologize to the Marlins organization for my behavior," Martinez said. "I have made some comments to certain players at certain times that I thought was more constructive criticism. Obviously, they didn't feel that way, and it kind of backfired on me."

Martinez said he once touched a player in anger, grabbing rookie Derek Dietrich by the jersey in the batting cage early this season. Dietrich, demoted last Monday to Double-A Jacksonville, was among the players to complain.

Martinez said he offered to resign earlier, but team owner Jeffrey Loria wanted him to stay on the job. When the complaints by players became public in a story Sunday by the Miami Herald, Martinez became certain he should resign.

"It has been building for a few days," he said. "I didn't know this was going to come out publicly. When this came out, I thought it was the right thing to do."

Marlins minor league field coordinator John Pierson will become interim hitting coach. First-year manager Mike Redmond said everyone in the organization was disappointed with the outcome of Martinez' brief tenure.

"Coaching's tough," Redmond said. "Going from a player to a coach is hard, and part of the grind is learning how to deal with different situations with different players and different personalities. All that stuff is a challenge. Some people can do it, and some people can't."

The young Marlins rank last in the majors in runs, home runs, batting and slugging, and the 45-year-old Martinez said he became frustrated as players struggled.

"I just thought with some young players you needed to be a little firmer and try to get them on the right track," he said. "I probably used some four-letter words. I thought I was doing the right thing. Obviously, I wasn't."

Martinez batted .271 with 339 home runs, and he was a four-time World Series champion with the New York Yankees. He had a three-year contract with the Marlins but said because he resigned, he'll receive no buyout.

He declined to speculate on whether he'll coach again.

"I don't know long term how it's going to affect me," he said. "Right now I'm disappointed in myself. I'm embarrassed. Right now I'm not worried about the future. I just want to make sure my family is OK."

Texas turtle with 2 heads crawls into hearts, Facebook

Published: Sunday, July 28, 2013, 5:39?p.m.
Updated 1 hour ago

SAN ANTONIO ? A two-headed turtle born last month at the San Antonio Zoo has become so popular her keepers started a Facebook page for her, the San Antonio Express reported.

?We get inquires from people wanting to know how they're doing,? said zoo spokeswoman Debbie Rios-Vanskike, who gets calls and emails from around the world about the two-headed Texas cooter, named Thelma and Louise.

While uncommon, two-headed turtles occasionally hatch as a result of twin embryos that didn't fully separate. So far, it appears that Thelma and Louise, born on June 18, are completely healthy.

?They are doing amazing,? Rios-Vanskike said. ?They're eating. They're getting along. They're swimming together. There are no signs that there's anything wrong with them.?

The Facebook page on Sunday listed Thelma and Louise as a single female who attended the ?University of Turtledome.? Favorite bands include the Turtles.

In cash-strapped Detroit, few question sports arena funding

By Joseph Lichterman

DETROIT (Reuters) - While Detroit has become a top emblem of U.S. urban economic decline with its recent bankruptcy filing, it remains a resilient and vibrant sports town.

Major League Baseball's Tigers and the National Football League's Lions, like teams in other U.S. cities, have obtained public financing for new arenas, despite questions about their promised economic windfalls.

The Tigers' home stadium Comerica Park, which opened in 2000, was built at a cost of $300 million, 38 percent of which was publicly financed. Tigers owner Mike Ilitch, who also owns the Red Wings, paid $185 million. Indian casino revenue and a voter-approved 2 percent rental car tax and 1 percent hotel tax paid the public's share, according to the National Sports Law Institute at Marquette University.

Ford Field, the Lions' domed stadium, was built next door to Comerica and opened in 2002 at a cost of $430 million, 36 percent of which was publicly financed by the same Wayne County tourist tax and payments from the city of Detroit, the state of Michigan, and the quasi-public Downtown Development Authority. The Lions, owned by Henry Ford's grandson William Clay Ford Sr., paid $70 million. There were also $50 million in other corporate contributions, the institute said.

And while area bars and restaurants are typically packed on game days, the neighborhood is a ghost town when neither team is playing. After the games, most fans go straight back to their homes in the suburbs.

Sports economist Andrew Zimbalist, a professor at Smith College, compared the economic impact of a new stadium to that of a large grocery store or department store.

"As a general matter, stadiums and arenas basically reallocate geographically spending within a metropolitan area," he said, adding that most of the money spent at sporting events goes to cover team costs like payroll. The Tigers, for instance, have the fifth-highest payroll in baseball, paying their players a combined $148 million.

Still, a state board recently approved issuing bonds to help pay for a new arena for the Red Wings at the heart of a proposed 45-block entertainment district just north of downtown.

The total project is slated to cost $650 million. About 44 percent of the project would be financed through public sources. Most of the public money will come through state property tax abatements on the now mostly vacant land where the arena will be built.

Despite such questionable economics, the project faced only modest local opposition.

Gretchen Whitmer, the Democratic leader in the Michigan State Senate, said the state would be better off investing money in areas like public safety or schools.

"I think the best investment we can make as a state is to ensure that we have good schools, that we have public safety that will show up in a time of crisis, those are the types of things that really draw residents into the city of Detroit and I would say that's the best type of investment we can make as a state if we want to get people living in the city," Whitmer said.

Nonetheless, some still contend the costs are worth it for what a new stadium contributes to a city's psyche.

"You can show me a spreadsheet, and I'll still trump you because it's the psychic benefit of having a sports club," sports historian John Thorn said. "It separates a city from thinking of itself as big league or thinking of itself as bush league."

Warm weather means early Calif. wine grape harvest

SACRAMENTO, Calif. (AP) ? There's no such thing as "normal" weather in California wine country, and vineyard operators say this year that truism could mean good news for wine lovers.

After cool temperatures slowed ripening and kept grapes on the vine until fall in recent years, growers in the nation's premier wine region are facing a heat wave that has made for one of the earliest harvests in recent memory.

"It has been a challenging year," said Michael Silacci, winemaker at Opus One in Napa Valley. "But it's shaping up to be an excellent year."

Weather hasn't been this warm across the region since 1997, a year that produced a highly regarded vintage. If the heat continues as expected it could mean fruit-intensive wines from an early and abundant crop.

"We're a full month ahead of 2009, '10 and '11," said Jon Ruel, COO at Trefenthen Vineyards and president of the Napa Valley Grapegrowers.

Dealing with changing weather patterns is part of the art of growing wine grapes, a long dance with the elements to achieve a precise combination of sugar levels and acidity expected from one of California's top commodities, a crop worth $3.2 billion on the vine last year, which created more than $34 billion worth of wine.

To bring in that harvest, growers are accustomed to being flexible. "There's no such thing as a normal year," Ruel said. "And this isn't a normal year."

Growers can remove leaves to let more sunshine hit fruit. They can drop clusters to improve flavors and quicken ripening in cool years. And they constantly monitor forecasts to know when an early shot of water will help get vines through a heat wave.

For this vintage, vineyard operators started picking grapes used to make sparkling wines this month, a move that came toward the end of August last year. And they're watching cabernet, merlot and pinot noir grapes, which are already in veraison, turning red and starting to ripen.

"Everything is moving at a faster pace," said Silacci, of Opus One, the cellar founded in 1979 by the Rothschilds of France and Robert Mondavi as one of the first for ultra-premium wine in the U.S.

Weather changes are a major factor that makes vintages distinctive. In the case of Opus One, the cool 2011 season produced a Bordeaux blend with herbal and fresh fruit notes. The weather was warmer in 2007, producing wines with the flavor of ripe fruit.

"We want every vintage of wine we make to give you a sense of time and place," Silacci said. "We're not making Budweiser, where a customer wants it to taste the same as the last can."

Growers faced an early harvest in 2004 because it was a relatively warm year. But because it was a very light crop, the grapes ripened quickly. This year's crop is much larger, so it won't ripen quite as early, growers say.

"We would worry that if we had a warm year and a low crop level we'd end up with excessive sugar and tannin development and a very early harvest," said Jason Haas of Tablas Creek.

"Higher yields mitigate against excessive sugar and tannins, which is great," he said, mentioning the compound that gives a dry and bitter finish to red wine.

The early harvest raises concern, however, for growers that rely on extended "hang time," the stint grapes spend on the vine. Many winemakers say time on the vine leads to complex flavors and a sense of place, called terroir.

In Lodi, Layne Montgomery of m2 makes zinfandel with mature flavors and relies more long hang times. He's planning for harvest three weeks ahead of normal. ("Whatever the hell normal is anymore," Montgomery said.) And the schedule gives him pause.

"I need as much time in the vineyard as we can get to get the great flavors," he said. "It's a little worrisome that things are looking so early."

But Montgomery's syrah grapes come from Amador County in the Sierra Foothills and have not endured as much heat. That vineyard is on a similar schedule to last year. And Haas expects to harvest his Rhone grapes in Paso Robles about a week ahead of last year's season.

If August weather goes as expected, "we should be right in line with what we saw last year," said Haas, who describes the 2012 vintage as "excellent."

Internet Marketing Solutions: Dealing With The Fear Of Commitment

Submitted by: Andy Eliason

Fear of commitment. To some degree we've all experienced it. Relationships are a difficult thing, whether they are social relationships or business relationships, we still have some natural hesitancy to fully commit to someone or something. As you search for Internet marketing solutions, from a company or packaged as software tools and applications, a little fear is a good thing. But if your fear controls you, the right Internet marketing solutions might pass you by.

Internet marketing solutions come in many shapes and sizes, and many times they will be accompanied by Claims or, even worse, Guarantees. And, when it comes to Internet marketing solutions, Claims and Guarantees should cause more fear than Commitment does. So in the instances where these solutions seem held up by Claims and Guarantees, treat them as you would any other relationship that seems too good to be true ? with skepticism and a healthy dose of paranoia.

Common wisdom has taught us all through the years that things which seem too good to be true probably are. Internet marketing solutions are no different. A Guarantee that a company can get you a number one ranking or claim that they will put you at the top of Google within a given time frame definitely fits into this category.

Google itself tells you in their Webmaster Help Center that no one can guarantee a #1 ranking in Google. And, for better or for worse, the people who are making Google work are a lot smarter than most of us. So in these cases of Claims and Guarantees it's okay to let your Fear guide your decisions.

Which is not to say that all of those promises are blatantly false. It really could be that some of those companies have a ?system? or ?method? that will get you to the top of the search results, but, strangely enough, the guarantees don't seem to include the length of time you will remain at the top. And it probably goes without saying (but I'm going to say it anyway) that they also very specifically don't guarantee that you won't get banned.

And when we look at it this way, at least we can say that our Fear of Commitment is not completely irrational. Companies that employ unethical Internet marketing solutions can get you to the top. They can also cause irreparable harm to your business and reputation.

At the same time, if you want to succeed on the Internet you have got to face your fears, cope with your hesitations, and confront your worries. (And any other encouraging statements you feel might apply.) Because not every company is like that, and there are a number of ethical, established, and proven Internet marketing solutions, and the right Internet marketing company can help you build a powerful web presence and improve your overall marketing strategy.

A couple methods that are common practices in Internet marketing include search engine optimization (SEO) and Pay-Per-Click (PPC). Both require skilled and knowledgeable application, but both can help you develop your online strategy and work your way up the search engine results.

However, SEO is not a quick or instant method. It takes time. And we've already discussed how the companies that promise instant SEO are justifiable sources of fear. Unfortunately a company's fear of commitment can often influence decisions when, in fact, you should be standing up to your fears. Fear enters corporate mentality when things don't progress as fast as they think it should. The wrong expectations can create the kind of fear that leads to bad decisions.

We can draw the same analogy to social relationships. How many of them have gone south because, even though both parties want the same outcome, they let their different expectations about how to achieve the end result destroy their chances of getting there. If you want to succeed it takes time. And more importantly, it takes commitment.

The moral of the story: Don't let your fear of commitment stop you from trying to find the right Internet marketing solutions. Not every relationship is going to work out on your first try, but if you really want to achieve the best possible outcome, you'll keep at it until the method and the achievement are exactly what your business needs.

Spanish train driver's declaration delayed

SANTIAGO DE COMPOSTELA, Spain (AP) ? The arrested driver of the Spanish train that derailed at high speed, killing 78 and injuring dozens more, is still in the hospital and won't appear before a judge as hoped on Saturday, delaying a hotly awaited opportunity for his official explanation for Spain's deadliest crash in decades.

Blame has increasingly fallen on the driver, with the country's railway agency saying it was his responsibility to brake before going into the high-risk curve where the train tumbled off the rails and smashed into a wall. But it's still not clear whether the brakes failed or were never used, and the driver has remained silent so far.

Francisco Jose Garzon Amo remains under arrest in the hospital on suspicion of recklessness. A blood-soaked Garzon was photographed Wednesday being escorted away from the wreckage, at first by civilians who had hurried to the scene of the accident and then by police, but it is not clear just what his medical status is.

Unconfirmed media reports said that Garzon had injured ribs.

The justice department had said that Garzon would likely testify before a judge Saturday, but said in a statement it intended now to wait until the 52-year-old is able to appear in court rather than having a judge come to his hospital bedside.

He had been expected to give a preliminary statement to judicial police as early as Thursday, but that process was delayed, reportedly due to health reasons.

In Wednesday's crash, the train's eight carriages packed with 218 passengers blazed far over the speed limit into a curve and violently tipped over. Diesel fuel powering the engine sent flames coursing through some cabins.

The president of Adif, the Spanish rail agency, said that the driver should have started slowing the train 4 kilometers (2.5 miles) before the dangerous bend. He said signs clearly marked this point when the driver must begin to slow.

Normally, police take a first statement that is then examined by an investigating judge who must then take testimony within 72 hours of the arrest. That deadline is Sunday, suggesting that Garzon will make some sort of declaration before a judge then.

Although the court hearing would be closed, it would give hints about the status of the investigation. The judge would decide whether to jail the driver as an official suspect, release him on bail, or release him without charges. If a judge finds sufficient evidence for a criminal trial, the suspect will be charged and a trial date set.

HBO to 'Thrones' author: 'Get busy writing'

George R.R. Martin worries that "Game of Thrones" could outpace his books.

What's going to happen if HBO's "Game of Thrones" catches up to author George R.R. Martin's five finished tomes? It's a question that's been on fans' minds, and it's a scenario the network wants to avoid.

The show wrapped up its third season earlier this year, but had already started touching on revelations from book four of the "Song of Ice and Fire" series from which the epic fantasy drama is based. Martin currently has five of the planned seven novels on the market, with no release date yet available for book six. The series is expected to finish after the seventh novel.

On Thursday, the subject was broached again with HBO executives Mike Lombardo and Richard Plepler at the Television Critics Association's summer press tour in Beverly Hills.

"As far as I'm concerned, it can go on as long as there are stories to tell," Lombardo replied when asked if the show could go beyond seven seasons to match the number of novels. "We certainly haven't gotten anywhere near that conversation with (show creators) David (Benioff) and Dan (Weiss) yet."

"Our line to George was, 'You keep writing,' " added Plepler.

"Yes, 'Get busy writing,' " Lombardo emphasized.

Martin is known for sometimes taking long periods to finish his lengthy tomes. After releasing the first three novels with just two years between each book, it took him another five years after the third book to release the fourth, and nearly six years after that for book five to hit shelves in 2011.

But like fans and HBO, Martin worries that the show will catch up to his books.

"I'm writing very fast because my great fear is that David and Dan will catch up with me,? he told Conan O'Brien in June.

"It's true that they're moving faster than I am ? the series has its own speed ? but I don't see us catching up for another three years or so, by which time another book will be out," he told The Hollywood Reporter in May. "That should give them another two seasons of material. And while I'm writing the last book, they'd be making those."

Though there is no release date yet for book six, titled "The Winds of Winter," but the author has posted excerpts on his website.

Ultra-thin e-skin could lead to advances in medicine, cool wearable computing (video)

DNP eskin

Remember the names Martin Kaltenbrunner and Takao Someya -- that way, you'll have someone to blame when kids start pointing and laughing at gadgets we consider high-tech today. Leading a team of University of Tokyo researchers, they have recently developed a flexible, skin-like material that can detect pressure while also being virtually indestructible. Think of the possibilities: with a thickness of one nanometer, this could be used to create a second skin that can monitor your vital signs or medical implants that you can barely feel, if at all. Also, temperature sensors could be added to make life-like skin for prosthetics... or even robots! Like other similar studies, however, the researchers have a long journey ahead before we see this super-thin material in medicine. Since it could lead to bendy gadgets and wearable electronics first, don't be surprised if your children call iPhones "so 2013" in the not-too-distant future.

Egyptian security forces shoot dead dozens of pro-Mursi supporters

By Tom Perry and Noah Browning

CAIRO (Reuters) - Egyptian security forces shot dead at least 70 supporters of ousted President Mohamed Mursi on Saturday, his Muslim Brotherhood said, days after the army chief called for a popular mandate to tackle "violence and terrorism".

Brotherhood spokesman Gehad El-Haddad said the shooting started shortly before pre-dawn morning prayers on the fringes of a round-the-clock sit-in being staged by backers of Mursi, who was toppled by the army more than three weeks ago.

"They are not shooting to wound, they are shooting to kill," Haddad said. The death toll might be much higher, he said.

Activists rushed blood-spattered casualties into a makeshift hospital, some were carried in on planks or blankets. One ashen teenager was laid out on the floor, a bullet hole in his head.

Al Jazeera's Egypt television station reported that 120 had been killed and some 4,500 injured in the early morning violence. A Reuters reporter at the scene counted 36 bodies at an improvised morgue.

There was no immediate comment from state authorities on what had happened. If the death toll is confirmed it would be the deadliest incident since Mursi was deposed, who is under investigation for a raft of crimes, including murder.

Weeks of violence have followed his ousting, leaving more than 200 dead and laying bare divisions that have polarized the Arab world's most populous state.

MASS RALLIES, "LIVE ROUNDS"

Hundreds of thousands of Egyptians came out onto the streets in answer to General Abdel Fattah al-Sisi's call on Wednesday for mass protests on Friday. Muslim Brotherhood supporters protested in similar numbers to demand Mursi's reinstatement. He is being detained at an undisclosed location.

The Brotherhood is a highly organized movement with grassroots support throughout Egypt, making it hard to silence even if the army decides to mount a more major crackdown.

Reporters at Rabaa al-Adawia, a northeastern Cairo suburb, said there was still firing hours after the violence started. Dr. Ibtisam Zein, overseeing the Brotherhood morgue, said most of the dead were hit in the head, some between the eyes.

A senior Brotherhood politician, Saad el-Hosseini, said he thought security forces were looking to clear the Rabaa sit-in.

"I have been trying to make the youth withdraw for five hours. I can't. They are saying have paid with their blood and they do not want to retreat," he told Reuters.

Haddad said the Brotherhood was committed to pursuing peaceful protests, despite Saturday's deaths - the second mass shooting of its supporters this month by security forces, who killed 53 people on July 8.

Brotherhood activists at Rabaa said they would not be cowed and warned of worse bloodshed if the security forces did not back down. "We will stay here until we die, one by one," said Ahmed Ali, 24, helping treat casualties at the field hospital.

"We have the examples of Algeria and Syria in our minds. We don't want it to become a civil war. If we take up arms it might become one. This is a religious belief."

Haddad said police had started firing repeated rounds of teargas after 3:00 a.m. (0100 GMT) at protesters who had spilled out of the main area of the Rabaa sit-in and were on a main thoroughfare close to 6th October Bridge.

"Through the smog of the gas, the bullets started flying," he said. In addition to "special police forces in black uniforms" firing live rounds, he said that snipers shot from the roofs of a university, other nearby buildings, and a bridge.

State news agency MENA quoted an unnamed security source as saying that only teargas was used to disperse protesters. He said no firearms were used.

Egypt's army-installed interior minister, Mohamed Ibrahim, said on Friday that the month-old Cairo vigils by Mursi supporters would be "brought to an end soon and in a legal manner", state-run al Ahram news website reported.

TRAPPED IN MOSQUE

There is deepening alarm in the West over the army's move against Mursi. The country of 84 million people forms a bridge between the Middle East and North Africa and receives $1.5 billion a year in mainly military aid from Washington.

The United States has delayed delivery of four F-16 fighters because of the turmoil, however, officials have indicated they do not intend to cut off aid to a country seen as a vital ally and which has a peace deal with neighboring Israel.

The worst of Friday's violence was reported in Egypt's second city, Alexandria, and the Brotherhood said some of its supporters were still trapped in a city mosque by "thugs".

The Brotherhood's political arm, the Freedom and Justice Party, called for more protests in the Mediterranean port.

There was little mention of the violence on Egypt's two state television channels, which broadcast weather reports and a talk show on Saturday morning. All three state newspapers headlined their morning editions with Friday's rallies, saying Egyptians had given Sisi the support he had asked for.

"The people give the army and the police a mandate to confront terrorism," said a strap headline on the bottom of a broadcast on the state's Nile TV.

However not all Egyptians appeared ready to endorse an army crackdown, with growing concern among some activists that the confrontation between the military and Islamists could push the country into an abyss.

3-year extension for Blackhawks coach Quenneville

Players lined the wall and watched intently Friday as Blackhawks general manager Stan Bowman formally announced a three-year contract extension for coach Joel Quenneville.

Positioned nearby, gleaming under the television lights, was the Stanley Cup.

It?s because of those players ? especially those forming the solid core in place for future seasons ? and that coveted trophy that the organization and it?s on-ice leader were motivated to forge a new deal through the 2016-17 season.

?I feel very fortunate to be a part of this organization,? Quenneville said before the opening of the Blackhawks Convention at Hilton Chicago. ?It?s a special place to work and play (and) it?s a special place to live. We love everything about Chicago. It?s a great sports town. I feel privileged to be part of something special. Winning here makes it even more enjoyable. From top to bottom, there are a million reasons why it?s such a perfect spot.?

Quenneville has led the Hawks to two championships since being named the 37th coach in franchise history on Oct. 16, 2008. With the Hawks, he has compiled a 222-106-44 record in 372 regular-season games.

Following their Cup victory over the Bruins last month, Bowman has tinkered with the roster as opposed to tearing it apart like the salary-cap purge after the ?10 title. That sets up Quenneville to be at the helm with players such as Jonathan Toews, Patrick Kane, Patrick Sharp, Marian Hossa, Duncan Keith and Brent Seabrook for the next few seasons.

?Looking at our team, I?m excited,? Quenneville said. ?We?re still young and the upside of this team going forward is still in place. I don?t think there?s too much difference from where we were exiting this season and going forward.

?We feel we?re going to have a strong team and we?d love to get back to where we ended the season. I can?t say enough about how many good attributes (there are) about being here.?

Said veteran winger Sharp: ?It?s exciting for the organization to keep a coach like that around. He has a proven track record where he has had success everywhere he has been, especially here in Chicago. We?re happy to have him.?

Over parts of 16 years coaching in the NHL, Quenneville has recorded a 660-389-162 record with the Blues, Avalanche (2005-08) and Hawks. He leads active head coaches and ranks sixth in NHL history in victories.

?There?s no one we want coaching this team more than Joel,? Bowman said. ?He has done a fantastic job over the years and the record speaks for itself. We?ve had consistent performance year after year ? culminating in the ultimate, winning the Stanley Cup two times.

?He has a presence behind the bench and we have a lot of faith he?s going to be able to get things done.?

Penguin Appeases European Union Regulators by Abandoning E-Book Deal with Apple

Penguin Appeases European Union Regulators by Abandoning E-Book Deal with Apple

Published on 07-25-2013 07:57 PM

The European Commission recently announced that it has reached an agreement with book publisher Penguin, resulting in the antitrust probe against the company ending. The EU?s legislative arm officially approved the conditions it and Penguin reached earlier. As part of the terms of those conditions, Penguin won?t make any agreements that would allow it, and not a retailer, to set prices on titles.

This agreement brings to an end the so-called ?most favored nation? pricing agreement that Penguin had with Apple, which allowed the publishers to set content pricing as long as it didn?t sell said content to another retailer for less. Previously, major book publishers and Apple had agreed to an ?agency model? of pricing when the iPad with iBooks debuted. This was a change from the ?wholesale model? they had before with book sellers such as Amazon, which were allowed to resell e-books at or below cost.

Apple?s e-books deals found the company under fire in both the U.S. and in Europe. Both Apple and the accused publishers outside of Penguin reached a settlement in Europe in December, but Apple fought an antitrust suit from the U.S. Department of Justice in its home country. Apple unfortunately lost that case, as a judge found that Apple had conspired with book publishers to raise the price of e-books. The Cupertino California company has appealed the decision but if the ruling stands, it is being speculated that Apple could pay nearly $500 million in damages. We?ll have to wait and see.

MarketWatch First Take: Facebook makes mobile ads pay off big

By MarketWatch

SAN FRANCISCO (MarketWatch) ? Facebook Inc. investors who are also users have probably noticed an increase in the ads in their news feed when they are using the social network.

Facebook CEO Mark Zuckerberg

And as annoying as those ads are, they are filling Facebook?s /quotes/zigman/9962609/quotes/nls/fb FB +1.45% ?coffers, which helped goose the company?s strong second-quarter results well above Wall Street?s estimates and sending the stock jumping nearly 17% n after-hours trades ? putting the shares above the $30 mark for the first time since early February.

On the conference call, Chief Executive Mark Zuckerberg did note that the company is working on improving the delivery to make the ads more relevant to each individual using Facebook.

For the quarter, 41% of Facebook?s total $1.6 billion in advertising revenue coming from mobile advertising, or about $656 million in mobile ad revenue. One analyst, Victor Anthony, of Topeka Capital Markets, for example, had been expecting about $435 million in mobile ad revenue.

Zuckerberg told investors at the outset of the call that the company will eventually see more revenue from mobile than standard desktop ads.

Facebook surprises investors

Facebook shares jumped nearly 20% in after-hours trading as Facebook surprised investors with big gains in revenue, earnings and active users for the second quarter on Wednesday.

The company also said that user engagement was still high, and that in fact people are spending more time on Facebook. Company executives also said that based on their data, they do not believe fewer teens are using the network, a constant fear of some investors who are on the social network more than their children. Still, Zuckerberg noted that teens lie about their age and that it is hard to measure.

Even with the after-hours jump, Facbook shares remain well below their $38 IPO price. Whether the stock will ever return to that level will be a big question for weeks to come, and the company will likely face tougher revenue comparisons in the next few quarters, because news feed ads started in the third quarter of last year.

But for now, investors seem happy with the company?s progress in mobile.
